Compliance Obligations by Role

The AI Act assigns obligations not by geography but by the role an organization plays in the AI value chain.

For Asian Providers (Developers and Vendors)

Providers of high-risk AI systems bear the heaviest burden: implementing risk management systems, ensuring data quality and governance, creating technical documentation conforming to Annex IV, deploying automatic logging, designing human oversight mechanisms, achieving baseline accuracy and cybersecurity standards, completing conformity assessment, affixing CE marking, registering in the EU database, providing user instructions, establishing post-market monitoring, reporting serious incidents, and maintaining a quality management system. Deployers of limited-risk systems must verify that transparency obligations are fulfilled and that users are informed of the AI nature of their interactions.

For Importers and Distributors

Importers serve as a critical compliance checkpoint, responsible for verifying that providers have completed conformity assessment, prepared technical documentation, applied CE marking, and supplied adequate instructions and contact details. They must also ensure appropriate storage and transport conditions and register systems in the EU database where the provider has not done so. Distributors bear similar verification obligations and must report suspected non-compliance to competent authorities.

EU Representative Requirement (Articles 23-24)

Non-EU providers of high-risk AI systems or GPAI models must appoint a written EU representative unless the provider is already established in the EU, the system is exclusively for export, or only minimal-risk systems are involved. The representative's responsibilities include verifying conformity assessment completion, maintaining copies of technical documentation and conformity declarations, and cooperating with competent authorities during investigations.

Enforcement and Penalties

Administrative Fines (Article 99)

The AI Act establishes a three-tier penalty structure that signals the seriousness with which the EU intends to enforce compliance.

The most severe tier carries fines of up to 35 million euros or 7% of global annual turnover, whichever is higher, for providing prohibited AI systems, violating data requirements under Article 10, or breaching transparency obligations for GPAI with systemic risk. The second tier imposes penalties of up to 15 million euros or 3% of global annual turnover for non-compliance with high-risk AI obligations beyond data requirements and for providing incorrect or misleading information to authorities. The third tier applies fines of up to 7.5 million euros or 1.5% of global annual turnover for violations of transparency obligations and for providing incorrect information to notified bodies.

For small and medium-sized enterprises, including startups, fines are capped at the lesser of the percentage-based or absolute thresholds within each tier. Penalty determination considers both aggravating factors, such as intentional non-compliance, prior infringements, refusal to cooperate, and impact on vulnerable groups, and mitigating factors, including effective compliance management, cooperation with authorities, self-reporting, and prompt remediation.

They may order cessation of AI system placement, temporarily restrict or suspend system availability, require modifications, conduct audits and inspections with access to technical documentation and source code, mandate risk communications to users, and initiate product recalls.

Achieving compliance requires a structured, phased approach that balances urgency with thoroughness. The following six-phase roadmap provides a realistic timeline for most organizations.

Phase 1: Applicability Assessment (Month 1)

The first task is determining whether and how the AI Act applies. Organizations must assess whether they place AI systems on the EU market, deploy systems whose outputs are used in the EU, or operate systems that affect EU persons, and document that determination. Simultaneously, they must identify their regulatory role (provider, deployer, importer, or distributor), determine whether they develop components for other providers or offer GPAI models, and create a comprehensive inventory of all AI systems potentially within scope.

Phase 2: Risk Classification (Month 2)

With the inventory in hand, each system must be classified as prohibited, high-risk, limited-risk, or minimal-risk through comparison against the Act's definitions and Annex III categories. The classification rationale, including detailed system analysis, risk assessment, and legal review, must be documented. Phase 4: Compliance Implementation (Months 4-12)

Implementation begins with governance: appointing an AI compliance officer or team, defining a governance framework, allocating budget, and, where required, appointing an EU representative. Technical measures follow, spanning risk management, data governance, logging and traceability, human oversight mechanisms, cybersecurity hardening, and transparency deployment. Documentation efforts must produce Annex IV-compliant technical documentation, risk management records, data governance documentation, conformity assessment reports, user instructions, and quality management system materials. Conformity assessment, CE marking, and EU database registration complete this phase.

Phase 5: Operationalization (Months 10-14)

With systems compliant and registered, attention shifts to sustained operation. Post-market monitoring plans must be established, capturing performance data, analyzing trends, and reporting serious incidents. Deployers require comprehensive instructions and training, supported by dedicated channels for questions and issues. Supply chain management, ensuring importer and distributor compliance and coordinating with the EU representative, becomes an ongoing function. Internal training programs must cover development teams, sales and marketing, and customer-facing staff.

Phase 6: Continuous Compliance (Ongoing)

Compliance is not a destination but a continuous process. Organizations must track evolving regulatory guidance and enforcement actions, monitor system performance, review and update risk assessments, and conduct periodic internal audits. Substantial modifications to AI systems may trigger re-assessment obligations, and evolving use cases may require reclassification. Active regulatory engagement, through stakeholder consultations, interaction with the European AI Office, industry association participation, and harmonized standards monitoring, positions organizations to anticipate rather than react to regulatory developments.

Strategic Considerations

Market Access vs. Compliance Cost

The central strategic question for Asian businesses is whether the EU market opportunity justifies the compliance investment. Organizations operating multiple high-risk systems, deploying novel technologies without established best practices, generating limited EU revenue, or facing resource constraints will find the cost equation most challenging.

Several strategies can shift that calculus favorably. Prioritizing EU market entry for high-value systems concentrates compliance investment where returns are greatest. Partnerships with EU-established entities can distribute the compliance burden. Phased market entry, beginning with lower-risk systems, allows organizations to build compliance capability incrementally. Build vs. Buy Compliance

Smaller organizations with limited AI portfolios or near-term market entry deadlines may find external compliance support more practical, accepting ongoing costs and external dependency in exchange for speed and specialist knowledge. Most organizations will gravitate toward a hybrid model: maintaining core compliance expertise internally while engaging external specialists for conformity assessments, legal interpretation, and domain-specific evaluations.

The strategic significance extends beyond Europe. The AI Act is already influencing AI regulatory frameworks in other jurisdictions, from Brazil to Canada to the ASEAN region.
